1. About Flog

Flog is a personal field journaling application designed to help users record, organize, and enrich outdoor experiences. The App combines information you provide, such as photos and notes, with contextual environmental data, including weather, location, and other publicly available information, to create detailed Field Logs.

2. License to Use the App

Subject to these Terms, Flog grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices that you own or control, solely for your personal, non-commercial use.

You may not:

• Copy, modify, or distribute the App.
• Reverse engineer or attempt to extract the App's source code.
• Circumvent security or technical protections.
• Use the App in any unlawful manner.

3. Your Field Logs and Content

You retain ownership of the photos, notes, observations, and other information you create using Flog.

Flog does not claim ownership of your content.

Because Flog stores your Field Logs locally on your device, you are responsible for maintaining backups of your own data. Deleting the App or your device may result in permanent loss of your Field Logs unless you have created your own backups.

4. Environmental and Contextual Information

Flog may display information obtained from publicly available or third-party data sources, including weather conditions, river data, tides, moon phases, sunrise and sunset times, species information, and similar environmental information.

• While we strive to present accurate information, we cannot guarantee that this information is complete, current, or error-free.
• Environmental conditions can change rapidly.
• You should not rely solely on information provided by Flog when making decisions involving outdoor recreation, navigation, safety, hunting, fishing, boating, foraging, or any other activity.
• You are solely responsible for your own safety and decisions.

5. Availability of Services

Some features of Flog may require an internet connection to retrieve environmental or reference information.

Third-party services may occasionally become unavailable, change, or discontinue providing data. As a result, certain features of Flog may become temporarily unavailable or function differently.

6. Intellectual Property

Flog, including its name, logo, design, software, graphics, and other original content, is owned by Flog and is protected by applicable intellectual property laws.

These Terms do not grant you ownership of any intellectual property rights in the App.

7. Updates

We may periodically release updates, improvements, bug fixes, or new features.

Some updates may be required for continued compatibility with your device or operating system.

8. No Warranty

Flog is provided "as is" and "as available."

To the fullest extent permitted by law, we make no warranties, express or implied, regarding the operation, availability, accuracy, reliability, or fitness of the App for any particular purpose.

We do not guarantee that the App will operate without interruption or be free from errors.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Flog and its developer shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the App.

This includes, but is not limited to:

• Loss of data
• Lost Field Logs
• Device failures
• Inaccurate environmental information
• Personal injury
• Property damage
• Financial losses
• Losses resulting from outdoor activities or decisions made while using the App

Your use of the App is entirely at your own risk.

10. Termination

These Terms remain in effect until terminated.

You may stop using Flog at any time by deleting the App from your device.

We reserve the right to modify or discontinue the App at any time.

11. Changes to These Terms

We may update these Terms from time to time.

The current version will always be available on our website.

Your continued use of Flog after updated Terms become effective constitutes acceptance of those changes.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of New York, without regard to its conflict of law principles.

Apple App Store Terms

If you downloaded Flog from the Apple App Store, you acknowledge that these Terms are between you and Flog, and not with Apple Inc. Apple is not responsible for the App or its content. Your use of the App is also subject to the applicable Apple Media Services Terms and Conditions.
